Parts Of Senate Bill 4 Will Take Effect Pending Court Proceedings

The Fifth Circuit issued a mixed ruling on the injunction against SB 4.

Austin, Texas – Today, the Fifth Circuit Court of appeals granted a partial stay against the U.S. District Court for the Western District of Texas’s temporary injunction against Senate Bill 4, the ‘sanctuary city ban’ that has garnered international attention.

State Rep. Eddie Rodriguez serves as policy chair of the Mexican American Legislative Caucus, the oldest and largest Latino legislative caucus in the nation.

State Rep. Eddie Rodriguez issued the following statement regarding the partial stay:

“No part of SB 4 should be allowed to take effect before its legality has been affirmed by the courts or the law has been struck down as the trial court deemed likely.

“SB 4 is unlike any legislation currently on the books in Texas or elsewhere in the nation, and experts have serious reservations regarding its infringement upon the freedom of speech and the right to due process under the law.

“Texas is batting 1.000 when it comes to findings of intentional discrimination by the Texas Legislature. At what point may we presume that the state is a bad actor requiring supervision by those who will protect Texans’ constitutional rights?

“Texans cannot wait nor afford another round of years-long litigation while this law tears families apart and sows distrust of and confusion among our law enforcement agencies.

“SB 4 must be disposed of in a timely manner so that the legislature can move on and get to work on the issues that matter to all Texans. If the court allows the state’s delay tactics to succeed, it will further normalize Texas Republicans’ dysfunctional one-party rule and condemn Texas Latinos to living under a cloud of uncertainty and fear.”
